Do I have a defence?
It is not a defence to the charge if the car is not yours or you did not know it was registered. The Prosecution do not have to prove that you knew it was unregistered.
You may have a defence if you honestly and reasonably believed that it was registered. For example, you have evidence that you made payment of the registration but there was some error with the processing of the payment.
What should I do?
It is important that you carefully consider what you say to police when you are pulled over. It is unlikely anything you say will change their mind about charging you with this offnence if the car is in fact unregistered.
