Theft Charges

Theft charges arise when you intentionally take something from another and intend to keep it. You can also be charged with theft if you find something and don’t try to return it to the owner or if you knowingly use stolen property as your own.

What should I do?

There are various level of theft charges and the seriousness really depends on the value of goods stolen. Also, stealing when you are in a position of trust is a much more serious example of theft.

Defences can include having a legal right to the property, having the owners consent to take the property or the owner could not be discovered by taking reasonable steps.

You should get legal advice before going to court.

Will I go to jail?

The value of the theft and who you stole from is a relevant consideration for sentencing. A breach of trust is serious, so if you stole from an employer or family member, your sentence may be more severe.

Your defence can be compromised without proper advice on how to deal with your record of interview. Make sure to get expert advice before you go to Court.
